Clinical legal education is playing an increasingly important role in educating lawyers worldwide. In The Global Clinical Movement: Educating Lawyers for Social Justice, editor Frank S. This paper explores Bakhtin’s reception of Goethe’s Wilhelm Meisters Lehrjahre with a view to assess how Bakhtin’s interest in this early chronotopical masterpiece can be understood in the wider context of his utopian thinking and his political eschatologies. Bakhtin reads Goethe’s novel as a critique of totalitarian forms of Socialist Realism as well as Dostoyevsky’s bourgeois realism. Like his contemporary Ernst Bloch, Bakhtin praises the complexity and richness of Goethe’s concept of realism. In the wake of Hermann Cohen, Georg (...) Simmel and Friedrich Gundolf to whom Bakhtin alludes and whom he quotes, Goethe is regarded as a modern literary and anthropological role model, the epitome of Bildung. For Bakhtin, Goethe’s and Rabelais’ writings about the carnivalesque constitute complementary forms of reflection of and agents for social and cultural transformation in modernity. (shrink)

This chapter considers the establishment freedom, concentrating on three aspects where recent European Court of Justice decisions have appeared to enlarge its scope but have also left unsolved questions on particular aspects. First, it looks at the nature of the establishment freedom, distinguishing it from the other freedoms, in particular the right to provide services and free movement of capital. Second, the chapter examines who are the beneficiaries of the right of establishment and, in particular, the position of legal persons, (...) companies, where harmonization of member states' company laws has achieved results but has not solved all problems. Finally, it addresses the question of which parties are obliged by the treaty to respect the right of establishment and considers a 2007 judgment, Viking, which, with the Laval decision concerning services, caused much criticism. The neural cell adhesion molecule (N‐CAM) is believed to be a key regulator of adhesive events in the nervous system and skeletal muscle. The recent isolation of N‐CAM cDNAs from different tissues has identified a high degree of diversity in primary amino acid sequence between different isoforms. In this article, we review these recent studies and discuss methods for unravelling the functional consequences of the generation of multiple N‐CAM polypeptides using gene transfection approaches.

: The Centers for Disease Control and Prevention (CDC) has recommended that HIV testing be routinely offered to certain patients in hospitals with a high prevalence of HIV infection and on all pregnant women. The CDC does not, however, offer implementation level guidelines for obtaining informed consent. We provide a moral justification for requiring informed consent for HIV testing and propose guidelines for securing such consent. In particular we argue that genuine informed consent can be secured without elaborate counseling, such (...) as that currently used at Counseling and Testing Sites, provided that sufficient written notice is given to the patients before testing and that they are specifically asked for permission.
